
WASHINGTON (TND) – In the coming days, the Department of Justice is expected to release details from a yearlong investigation into classified government documents found at President Joe Biden's former office in Washington and home in Wilmington, Delaware.
The Washington Post was first to report Special Counsel Robert Hur's report will be released soon and prosecutors will not seek criminal charges.
It's been more than a year since a marathon of discoveries that Biden, former President Donald Trump and former Vice President Mike Pence possessed classified documents. Trump faces 40 felony counts as a result of Special Counsel Jack Smith's investigation into troves of classified documents found at Mar-a-Lago and Trump and his aides' alleged attempts to obstruct the investigation. A separate Department of Justice investigation concluded Pence should not be charged.
Former U.S. Attorney John P. Fishwick, Jr. said he expects Hur's report will provide the public a tremendous amount of transparency.
One of the advantages of a special counsel, in this case a former United States attorney appointed by former President Trump, is that the public will now get to see how did President Biden have these documents, why did he keep them, were they safe and did he turn them over as he has said, right away, to the National Archives or was there something else that took place there?” Fishwick said.Since the public learned about Biden and Trump's possession of classified materials, there's been intense scrutiny of how each of the presidents acted once the documents were discovered.
“Biden team argues, hey look when we found out about this we called the National Archives, we made arrangements to turn those documents back in. Jack Smith says that when we reached out to former President Trump, he was recalcitrant to turn those over and he obstructed the investigation. One advantage of these special prosecutors and the report from Mr. Hur is folks will be able to compare the two situations and make a decision for themselves.” Fishwick said.
After Hur's report is made public, Fishwick expects he will be called to testify before Congress to explain his findings.
"Not just President Biden but other individuals who touched these documents," Fishwick said. "Who knew about these documents? Is there potential criminal exposure to them? Time will tell.”
