
BOISE, Idaho (CBS2) — UPDATE: An execution date has been set for Thomas Creech of February 28, 2024, according to the death warrant.
ORIGINAL REPORT: The State of Idaho already issued a death warrant for Thomas Creech and his lawyers confirmed to CBS2, it was handed to him in his prison cell this morning.
According to state procedure, he would have then been moved to the F block of the prison to await execution, which would be carried out there.
In response, Creech's attorneys with Federal Defender Services of Idaho said in a statement, "We are hardly surprised state prosecutors aggressively obtained a death warrant as they relentlessly pursue a campaign of vengeance against Tom Creech. We are far from done fighting to save him from a needless execution. Ultimately, it will be impossible for them to execute the Tom Creech of 1974. He died inside Tom a long time ago, replaced by a harmless, remorseful, compassionate old man who has evolved into a valued, respected and beloved member of the prison community in which he has lived and been punished for 50 years."
Earlier, CBS2 confirmed with the Idaho Department of Corrections that they have secured the necessary chemicals to carry out the lethal injection. He will not be the first death row inmate to face the firing squad since it was reintroduced by the legislature in 2023.
Creech could still receive a stay of execution from the Governor, though his statement following the Parole Board's decision would make that sound unlikely.
